AGREEMENT OF NON-CRIMINAL PROSECUTION: the requirement of confession in the light of the federal constitution
Abstract
Esta pesquisa possui como objetivo entender a exigência de confissão para a realização do Acordo de Não Persecução Penal (ANPP) e passá-la pelo filtro constitucional, verificando se viola norma prevista na Constituição. Para isso, foi necessário analisar o ANPP e identificar como se dá a aplicação desse na prática processual penal brasileira. O problema a ser solucionado era o porquê da exigência de confissão. Após estudos de Direito Comparado com institutos do Direito estadunidense e alemão; da análise procedimental do acordo, prevista no caput e nos incisos do Art. 28-A do Código de Processo Penal; da comparação entre o ANPP e a suspensão condicional do processo e a transação penal; e da confissão como prova no Processo Penal, o resultado encontrado ao final da pesquisa é a incompatibilidade da exigência da confissão com a Constituição Federal vigente.
