BULLYING AT SCHOOL: FROM HUMAN RIGHTS VIOLATIONS TO CIVIL LIABILITY

Abstract

 Attending an educational institution from an early age is a fundamental right for children and adolescents and essential for their development. However, the presence of bullying violates this guarantee and the prerogatives of the personality. In view of this, the aim is to identify the main studies, classifications and existing forms of bullying; the rights violated and the consequences for the victim's physical and psychological safety, as well as to analyze the institute of civil liability, highlighting its impact on public and private schools. As for the methodology, a narrative literature review was used, through a bibliographic survey of books, e-books, articles, scientific journals, websites, statistical data, and an analysis of current legislation and case law. It was therefore observed that both private and public schools must ensure the integrity of their students. In the first case, they will be held liable under the activity risk theory and, in the second, the state will be held objectively or subjectively liable, depending on which theory is used.
