THE CIVIL LIABILITY OF THE LEGAL PERSON IN THE DEVELOPMENT OF ENVIRONMENTAL DAMAGES
Abstract
This article aims to address some relevant points related to the Legal Institute of Civil Liability, with regard to the activities of the legal persons when in some way cause damage or injury to the environment. It was initially sought to conceptualize environment, civil liability, to then address the theories of the integral risk and the risk created, to then conclude that the repair that is sought in the form of environmental compensation is not intended to remove the stimulus of legal person or extinguish it from the market, since every society has an interest in its progress, but what is sought with environmental compensation is a way of slowing down the damage that the collective has suff ered due to the lack of discernment of own legal person.
