THE CONTRADICTORY AND THE BROAD DEFENSE IN THE POLICE INVESTIGATION FROM THE PERSPECTIVE OF DEFENSIVE CRIMINAL INVESTIGATION
Abstract
The study addresses the contradictory and the broad defense in the police investigation from the perspective of defensive criminal investigation as a fundamental right to evidence. The objective is to discuss whether contradictory and ample defense is possible in the preliminary phase of criminal prosecution, in order to guarantee parity of weapons, through the bias of defensive criminal investigation. The research methodology is bibliographic and documental that focus on the topic. The research is based on renowned and consecrated authors with their favorable and contrary theoretical proposals. In the end, it presents the defensive criminal investigation as a tool available to the technical defense for the exercise of contradictory and ample defense in the police investigation for the production of evidence in parity of arms.
