THE STRUCTURAL SUIT AS A MECHANISM OF ACCESS TO SOCIAL RIGHTS BY VULNERABLE GROUPS: the ressignification of the role of judiciary

Abstract

This article seeks to bring a proposal for action by the Judiciary in the face of public policies for vulnerable groups. The collective dimension of social rights is important to restore the loss of balance in the socio-economic relations of certain social groups systematically excluded from social rights and dependent on the State of Social Welfare to ensure their minimum existential. The possibility of judges to mediate efforts for a dialogue with stakeholders and specialists will be explored, as well as to act in coordinated actions, developed in stages, for the implementation of the social rights postulated in favor of the community.
