THE CONSTITUTIONAL BASIS OF THE BRAZILIAN CODE OF CONSUMER PROTECTION AND DEFENSE
Abstract
Brazilian legislation is characterized as a specific legal system of protection and consumer defense, considered as one of the most advanced in the world. This paper aims to present some considerations regarding the evolution of consumer law and the constitutional basis in the Consumer Protection and Protection Code, as well as to present some considerations that have led to the legislative option for a codified but open, principiological and extremely advanced system for a country with serious social problems and still in development. Some historical considerations will be made regarding the legislative evolution, because of the intense commercial relations that came with the Industrial Revolution and a notorious situation of consumer helplessness, which led the Right to walk in the direction of support, directly or indirectly.
